1. Acceptance of Terms
By accessing or using Daneel ("the Service"), a concierge presence intelligence service operated by My AI 4 Life ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and My AI 4 Life. You must be at least 16 years old to use Daneel.
2. Description of Service
Daneel is a personal presence intelligence service that provides proactive assistance through messaging platforms, including WhatsApp, Apple iMessage, and webchat. Daneel remembers context across conversations, anticipates needs, and acts on your behalf when invited to do so. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
3. AI Disclosure (California SB 243 Compliance)
You are interacting with an artificial intelligence system, not a human being. Daneel uses large language models and automated systems to generate responses. In accordance with California Senate Bill 243 and similar laws: • Daneel is an AI and will clearly identify itself as such upon request • Daneel is not a licensed professional (medical, legal, financial, or mental health) • Daneel's responses should not be treated as professional advice • If you are experiencing a crisis or emergency, contact appropriate emergency services or licensed professionals immediately Daneel is not a substitute for human judgment in critical decisions.
4. Human Assistance and Oversight
While Daneel is primarily an AI-driven service, certain interactions may involve human review or assistance by authorized personnel for quality assurance, safety, and service improvement. By using Daneel, you consent to potential human review of conversations where necessary for these purposes, subject to our Privacy Policy.
5. User Responsibilities
You agree to use Daneel responsibly and in accordance with all applicable laws. You are responsible for: • Maintaining the confidentiality of your account and connected services • All activity that occurs under your account • Providing accurate information when required • Not using the Service for unlawful, harmful, or abusive purposes • Not attempting to reverse engineer, scrape, or interfere with the Service • Not using the Service to generate content that is illegal, defamatory, or infringing You must not share your Daneel access with others or use the Service to impersonate another person.
6. Service Limitations
Daneel has known limitations you should understand before relying on it: • AI responses may occasionally be inaccurate, incomplete, or inappropriate • Memory and context recall is not perfect and may degrade over time • Integrations with third-party services (Google Calendar, Gmail, WhatsApp, etc.) depend on those providers and may fail • Messaging platforms may enforce their own limits, delivery delays, or content restrictions We make no guarantee of specific outcomes, response times, or continuous availability.
7. Intellectual Property
All content, software, design, trademarks, and materials associated with Daneel are the property of My AI 4 Life or its licensors and are protected by intellectual property laws. Your content — messages, preferences, and context you share with Daneel — remains yours. By using the Service, you grant us a limited license to process your content solely to provide and improve the Service, in accordance with our Privacy Policy. You may not copy, modify, distribute, sell, or lease any part of Daneel without our written permission.
8. Payment Terms
Certain features of Daneel may require a paid subscription. By subscribing, you agree to: • Pay all applicable fees in the currency shown at checkout • Provide accurate billing information • Authorize recurring charges for the subscription period you selected • Cancel at least 24 hours before the next billing cycle to avoid being charged Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice; continued use after a price change constitutes acceptance.
9. Platform-Specific Terms (WhatsApp and Apple Messages)
When you interact with Daneel through WhatsApp, you are also subject to WhatsApp's Terms of Service and Privacy Policy. WhatsApp messages are end-to-end encrypted between you and Daneel's official business account. When you interact with Daneel through Apple Messages for Business, Apple's terms and policies additionally apply. Messages sent through Apple Messages for Business are handled in accordance with Apple's privacy requirements. Standard messaging rates from your carrier may apply.
10. Termination
You may stop using Daneel at any time. We may suspend or terminate your access to the Service, with or without notice, if you: • Violate these Terms • Engage in conduct that is abusive, unlawful, or harmful to other users or our systems • Fail to pay applicable fees Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will remain in effect.
11. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components. You use Daneel at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, My AI 4 Life, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, goodwill, or other intangible losses, resulting from: • Your use of or inability to use the Service • Any AI-generated output or recommendation • Unauthorized access to or alteration of your data • Any third-party conduct or content on the Service Our total aggregate liability for any claim related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to first attempt to resolve any dispute informally by contacting us before initiating formal proceedings.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify users by posting the updated Terms on this page and updating the "Last updated" date. Significant changes may also be communicated through the Service. Your continued use of Daneel after any changes constitutes acceptance of the updated Terms.
